Florida is one state that has enacted a social host liability law. This law’s purpose is to curve liability away from social hosts in the event of an alcohol-related accident. For example, if a social host provides alcohol at a gathering and an DUI car accident occurs with guests involved, those guests cannot sue the host for damages.
In certain situations, however, hosts can be sued. Examples include:
- When a host knowingly provides alcohol to minors.
- When a host knowingly provides alcohol to individuals who are addicted.
- When the accident is partially caused by an unsafe condition on the host’s property (i.e. a rickety banister or slippery walkway).
